PANTAS SOFTWARE TERMS OF SERVICE

Thank you for selecting the Services offered by Pantas Software and/or its subsidiaries and affiliates (referred to as "Pantas Software", "we", "our", or "us"). Review these Terms of Service ("Agreement") thoroughly. This Agreement is a legal agreement between you and Pantas Software. By clicking “I Agree,” indicating acceptance electronically, or by, installing, accessing or using the Services, you agree to this Agreement. If you do not agree to this Agreement, then you may not use the Services.

Section A

GENERAL TERMS

1. AGREEMENT

This Agreement describes the terms governing your use of the Pantas Software Services. It includes by reference:

Additional terms and conditions, which may include those from third parties.
Any terms provided separately to you for the Services, including product or program terms, ordering, activation, payment terms, data processing agreements, etc.

You must be at least 18 years of age to use our Services. By accessing or using our Services you agree that:

You can form a binding contract with Pantas Software;
You are not a person who is prohibited from receiving the Services under the laws of Malaysia, or any other applicable jurisdiction; and
You will comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations, including import and export regulations.

2. YOUR RIGHTS TO USE THE SERVICES

2.1 The Services are protected by copyright, trade secret, and other intellectual property laws. You are only granted the right to use the Services and only for the purposes described by Pantas Software. Pantas Software reserves all other rights in the Services. Until termination of this Agreement and as long as you meet any applicable obligations and comply with this Agreement, Pantas Software grants to you a personal, limited, nonexclusive, nontransferable right and license to use the Services.

2.2 You agree not to use, nor permit any third party to use, the Services in a manner that violates any applicable law, regulation or this Agreement. You agree you will not:

Provide access to or give any part of the Services to any third party.
Reproduce, modify, copy, sell, trade, lease, rent or resell the Services.
Decompile, disassemble, or reverse engineer the Services.
Make the Services available on any file-sharing or application hosting service.

3. PAYMENT

Unless specified otherwise, it is free to use the Services offered by Pantas Software.

For Services offered on a payment or subscription basis, the following terms apply, unless Pantas Software or its third-party affiliate notifies you otherwise in writing. This Agreement also incorporates by reference and includes program ordering and payment terms provided to you on the website for the Services:

Payments will be billed to you in Malaysian Ringgit (plus any and all applicable taxes, including without limitation VAT, GST and SST), as shown in the product ordering and subscription terms, and your account will be debited when you subscribe and provide your payment information, unless stated otherwise in the program ordering or payment terms on the website for the Services.
You must pay with one of the following:

A valid credit card acceptable to Pantas Software;
A valid debit card acceptable to Pantas Software;
Sufficient funds in a checking or savings account to cover an electronic debit of the payment due; or
By another payment option Pantas Software provides to you in writing.

If your payment and registration information is not accurate, current, and complete and you do not notify us promptly when such information changes, we may suspend or terminate your account and refuse any use of the Services.
If you do not notify us of updates to your payment method (e.g., credit card expiration date), to avoid interruption of the Services, we may participate in programs supported by your card provider (e.g., updater services, recurring billing programs, etc.) to try to update your payment information, and you authorize us to continue billing your account with the updated information that we obtain.
Pantas Software will automatically renew your monthly, quarterly, or annual Services at the then-current rates, unless the Services subscription is cancelled or terminated under this Agreement.
Additional cancellation or renewal terms may be provided to you on the website for the Services.

4. USE WITH YOUR MOBILE DEVICE

Use of these Services may be available through a compatible mobile device, Internet access and may require software. You agree that you are solely responsible for these requirements, including any applicable changes, updates and fees as well as the terms of your agreement with your mobile device and telecommunications provider.

PANTAS SOFTWARE MAKES NO WARRANTIES OR REPRESENTATIONS OF ANY KIND, EXPRESS, STATUTORY OR IMPLIED AS TO:

THE AVAILABILITY OF TELECOMMUNICATION SERVICES FROM YOUR PROVIDER AND ACCESS TO THE SERVICES AT ANY TIME OR FROM ANY LOCATION;
ANY LOSS, DAMAGE OR SECURITY INTRUSION OF THE TELECOMMUNICATION SERVICES; AND
ANY DISCLOSURE OF INFORMATION TO THIRD PARTIES OR FAILURE TO TRANSMIT ANY DATA, COMMUNICATIONS OR SETTINGS CONNECTED WITH THE SERVICES.

5. DATA PROCESSING AND PRIVACY

Data Processing and Privacy. (a) Pantas Software is the controller of the personal information it processes about you when you use the Services and (b) You acknowledge that Pantas Software will process your personal information as described in our Privacy Statement (Click here) when you use our Services.

6. CONTENT AND USE OF THE SERVICES

6.1 Responsibility for Content and Use of the Services.

Content includes any data, information, materials, text, graphics, images, music, software, audio, video, works of authorship of any kind, that are uploaded, transmitted, posted, generated, stored or otherwise made available through the Services ("Content"), which will include without limitation any Content that account holders (including you) provide through your use of the Services. By making your Content available through your use of the Services, you grant Pantas Software a worldwide, royalty-free, non-exclusive license to host and use your Content. Archive your Content frequently. You are responsible for any lost or unrecoverable Content. You must provide all required and appropriate warnings, information and disclosures. Pantas Software is not responsible for any of your Content that you submit through the Services.
You agree not to use, nor permit any third party to use, the Services to upload, post, distribute, link to, publish, reproduce, engage in, promote or transmit any of the following:
1. Illegal, fraudulent, defamatory, obscene, pornographic, profane, threatening, abusive, hateful, harassing, offensive, inappropriate or objectionable information or communications of any kind, including without limitation conduct that is excessively violent, incites or threatens violence, encourages "flaming" others or criminal or civil liability under any local, state, federal or foreign law;
2. Content that would impersonate someone else or falsely represent your identity or qualifications, or that may constitute a breach of any individual’s privacy; is illegally unfair or deceptive, or creates a safety or health risk to an individual or the public;
3. Except as permitted by Pantas Software in writing, investment opportunities, solicitations, chain letters, pyramid schemes, other unsolicited commercial communication or spamming or flooding;
4. Virus, Trojan horse, worm or other disruptive or harmful software or data; and
5. Any Content that you do not own or have the right to use without permission from the intellectual property rights owners thereof.

6.2 Restricted Use of the Services.

You shall not, and shall not permit any users of the Services or any other party to, engage in, solicit, or promote any activity that is objectionable or may be illegal, violates the rights of others, is likely to cause notoriety, harm or damage to the reputation of Pantas Software or could subject Pantas Software to liability to third parties, including: (i) unauthorized access, monitoring, interference with, or use of the Services or third party accounts, data, computers, systems or networks; (ii) interference with others’ use of the Services or any system or network, including mail bombing, broadcast or denial of service attacks; (iii) unauthorized collection or use of personal or confidential information, including phishing, pharming, spidering, and harvesting; (iv) viewing or other use of any Content that, in Pantas Software’s opinion, is prohibited under this Agreement; (v) any other activity that places Pantas Software in the position of fostering, or having potential or actual liability for, illegal activity in any jurisdiction; or (vi) attempting to probe, scan, penetrate or test the vulnerability of an Pantas Software system or network or to breach Pantas Software’s security or authentication measures, whether by passive or intrusive techniques. Pantas Software reserves the right to not authorize and may terminate your use of the Services based on reasonable suspicion of your activities, business, products or services that are objectionable or promote, support or engage in any of the restricted uses described above.

6.3 Community forums.

The Services may include a community forum or other social features to exchange Content and information with other users of the Services and the public. Pantas Software does not support and is not responsible for the Content in these community forums. Please use respect when you interact with other users. Do not reveal information that you do not want to make public. Users may post hypertext links to content of third parties for which Pantas Software is not responsible.

6.4 Pantas Software may freely use feedback you provide.

You agree that Pantas Software may use your feedback, suggestions, or ideas in any way, including in future modifications of the Services, other products or services, advertising or marketing materials. You grant Pantas Software a perpetual, worldwide, fully transferable, sublicensable, non-revocable, fully paid-up, royalty free license to use the feedback you provide to Pantas Software in any way.

6.5 Pantas Software may monitor content.

Pantas Software may, but has no obligation to, monitor access to or use of the Services or Content or to review or edit any Content for the purpose of operating the Services, to ensure compliance with this Agreement, and to comply with applicable law or other legal requirements. We may disclose any information necessary to satisfy our legal obligations, protect Pantas Software or its customers, or operate the Services properly. Pantas Software, in its sole discretion, may refuse to post, remove, or refuse to remove, or disable any Content, in whole or in part, that is alleged to be, or that we consider to be unacceptable, undesirable, inappropriate, or in violation of this Agreement.

7. ADDITIONAL TERMS

7.1 Pantas Software does not give professional advice.

Unless specifically included with the Services, Pantas Software is not in the business of providing legal, financial, accounting, tax, health care, real estate or other professional services or advice. Consult the services of a competent professional when you need this type of assistance.

7.2 We may tell you about other Pantas Software Services.

You may be offered other services, products, or promotions by Pantas Software ("Pantas Software Services"). Additional terms and conditions and fees may apply. With some Pantas Software Services you may upload or enter data from your account(s) such as names, addresses and phone numbers, purchases, etc., to the Internet.

7.3 Communications.

Pantas Software may be required by law to send you communications about the Services or third-party products. You agree that Pantas Software may send these communications to you via email or by posting them on our websites

7.4 You will manage your passwords and accept updates.

You are responsible for securely managing your password(s) for the Services and to contact Pantas Software if you become aware of any unauthorized access to your account. The Services may periodically be updated with tools, utilities, improvements, third party applications, or general updates to improve the Services. You agree to receive these updates.

8. DISCLAIMER OF WARRANTIES

8.1 YOUR USE OF THE SERVICES, SOFTWARE, AND CONTENT IS ENTIRELY AT YOUR OWN RISK. EXCEPT AS DESCRIBED IN THIS AGREEMENT, THE SERVICES ARE PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PANTAS SOFTWARE, ITS AFFILIATES, AND ITS AND THEIR THIRD PARTY PROVIDERS, LICENSORS, DISTRIBUTORS OR SUPPLIERS (COLLECTIVELY, "SUPPLIERS") DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY THAT THE SERVICES ARE FIT FOR A PARTICULAR PURPOSE, TITLE, MERCHANTABILITY, DATA LOSS, NON-INTERFERENCE WITH OR NON-INFRINGEMENT OF ANY INTELLECTUAL PROPERTY RIGHTS, OR THE ACCURACY, RELIABILITY, QUALITY OF CONTENT IN OR LINKED TO THE SERVICES. PANTAS SOFTWARE AND ITS AFFILIATES AND SUPPLIERS DO NOT WARRANT THAT THE SERVICES ARE SECURE, FREE FROM BUGS, VIRUSES, INTERRUPTION, ERRORS, THEFT OR DESTRUCTION. IF THE EXCLUSIONS FOR IMPLIED WARRANTIES DO NOT APPLY TO YOU, ANY IMPLIED WARRANTIES ARE LIMITED TO 30 DAYS FROM THE DATE OF PURCHASE OR DELIVERY OF THE SERVICES, WHICHEVER IS SOONER.

8.2 PANTAS SOFTWARE, ITS AFFILIATES AND SUPPLIERS DISCLAIM ANY REPRESENTATIONS OR WARRANTIES THAT YOUR USE OF THE SERVICES WILL SATISFY OR ENSURE COMPLIANCE WITH ANY LEGAL OBLIGATIONS OR LAWS OR REGULATIONS.

9. LIMITATION OF LIABILITY AND INDEMNITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE ENTIRE LIABILITY OF PANTAS SOFTWARE, ITS AFFILIATES AND SUPPLIERS FOR ALL CLAIMS RELATING TO THIS AGREEMENT SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO SUCH CLAIM. SUBJECT TO APPLICABLE LAW, PANTAS SOFTWARE, ITS AFFILIATES AND SUPPLIERS ARE NOT LIABLE FOR ANY OF THE FOLLOWING: (A) INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES; (B) DAMAGES RELATING TO FAILURES OF TELECOMMUNICATIONS, THE INTERNET, ELECTRONIC COMMUNICATIONS, CORRUPTION, SECURITY, LOSS OR THEFT OF DATA, VIRUSES, SPYWARE, LOSS OF BUSINESS, REVENUE, PROFITS OR INVESTMENT, OR USE OF SOFTWARE OR HARDWARE THAT DOES NOT MEET PANTAS SOFTWARE SYSTEMS REQUIREMENTS. THE ABOVE LIMITATIONS APPLY EVEN IF PANTAS SOFTWARE AND ITS AFFILIATES AND SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS AGREEMENT SETS FORTH THE ENTIRE LIABILITY OF PANTAS SOFTWARE, ITS AFFILIATES AND YOUR EXCLUSIVE REMEDY WITH RESPECT TO THE SERVICES AND ITS USE.

You agree to indemnify and hold Pantas Software and its Affiliates and Suppliers harmless from any and all claims, liability and expenses, including reasonable attorneys' fees and costs, arising out of your use of the Services or breach of this Agreement (collectively referred to as "Claims"). Pantas Software reserves the right, in its sole discretion and at its own expense, to assume the exclusive defense and control of any Claims. You agree to reasonably cooperate as requested by Pantas Software in the defense of any Claims.

10. CHANGES

We reserve the right to modify this Agreement, in our sole discretion, at any time, and the modifications will be effective when posted through the Services or on our website for the Services or when we notify you by other means. We may also change or discontinue the Services, in whole or in part. It is important that you review this Agreement whenever we modify it because your continued use of the Services indicates your agreement to the modifications.

11. TERMINATION

Pantas Software may, in its sole discretion and without notice, restrict, deny, terminate this Agreement or suspend the Services, related or other Services, effective immediately, in whole or in part, if we determine that your use of the Services violates the Agreement, is improper or substantially exceeds or differs from normal use by other users, raises suspicion of fraud, misuse, security concern, illegal activity or unauthorized access issues, to protect the integrity or availability of the Services or systems and comply with applicable Pantas Software policy, if you no longer agree to receive electronic communications, or if your use of the Services conflicts with Pantas Software’s interests or those of another user of the Services. Upon Pantas Software notice that your use of the Services has been terminated you must immediately stop using the Services and any outstanding payments will become due. Any termination of this Agreement shall not affect Pantas Software’s rights to any payments due to it. Pantas Software may terminate a free account at any time. Sections 2.2, 3 through 14 will survive and remain in effect even if the Agreement is terminated.

12. GOVERNING LAW AND JURISDICTION

This Agreement will be governed by the laws of Malaysia, without regard to its conflicts of law principles. Notwithstanding the foregoing, you acknowledge that your breach (or an apprehension of breach) of any provisions of this Agreement, or any infringement (or apprehension of infringement) of Pantas Software’s or its Suppliers’ intellectual property rights may cause Pantas Software irreparable damage for which recovery of money damages would be inadequate. Accordingly, you agree that Pantas Software shall be entitled, in addition to any other remedies available to it, to seek (in any court of competent jurisdiction, notwithstanding the previous sentence) any relief (whether equitable or otherwise) to prevent or restrain any such breach or apprehended breach by you or otherwise to protect Pantas Software’s rights under this Agreement. The parties hereby submit to the exclusive jurisdiction of the courts of Malaysia and you agree that you will procure that any third party making a claim against Pantas Software arising out of this Agreement shall bring such claim exclusively in the Malaysia courts and subject to the limitations and exclusions of liabilities provided for in this Agreement.

Pantas Software does not represent that the Services and/or content within the Services is appropriate or available for use in all jurisdictions or countries. Pantas Software prohibits accessing content from within countries or states where such content is illegal. You are responsible for compliance with all applicable laws pertaining to your use and access to the Services in your jurisdiction.

13. LANGUAGE

Any translation of this Agreement is done for local requirements and in the event of a dispute between the English and any non-English version, the English version of this Agreement shall govern. In the event of a dispute the parties confirm that they have requested that this Agreement and all related documents be drafted in English.

14. GENERAL

This Agreement, including the Additional Terms below, is the entire agreement between you and Pantas Software regarding its subject matter and replaces all prior understandings, communications and agreements, oral or written, regarding its subject matter. If any court of law, having the jurisdiction, rules that any part of this Agreement is invalid, that section will be removed without affecting the remainder of the Agreement. The remaining terms will be valid and enforceable. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement. You may not assign or transfer this Agreement to anyone without written approval of Pantas Software. However, Pantas Software may assign or transfer this Agreement without your consent to (a) an affiliate, (b) a company through a sale of assets by Pantas Software or (c) a successor by merger. Any assignment in violation of this Section shall be void.

Section B

ADDITIONAL TERMS AND CONDITIONS FOR THE SERVICES

Your use of the Services provided by Pantas Software are subject to the general Terms of Service above including these Additional Terms and Conditions which govern your use of the Services indicated below. To the extent of any conflict or inconsistency with the general Terms of Service above, these Additional Terms and Conditions shall prevail.

Pantas Software Supplemental Agreement and Terms of Service

Thank you for selecting Pantas Software E-Invoicing and Financing Platform (“Pantas Service”). This license agreement in addition to the Pantas Software Terms of Service (the “Agreement”) is a legal agreement between the User, a single legal entity identified in the registration process provided as part of the start-up process (“User”, “you”), and Pantas Software Inc. and/or its subsidiaries and affiliates (“Pantas Software,” “we”, “our” or “us”).

By selecting “ACCEPT,” You indicate that you have read and understood, and assent to be bound by, the terms of this Agreement. If the person selecting “ACCEPT” is an individual working for you (“Agent”), such person is agreeing to the terms and conditions of this Agreement on behalf of you and represents and warrants to Pantas Software that he/she has full power and authority to enter into this Agreement on your behalf.

If you do not agree to the terms of the Agreement, you are not granted any rights whatsoever in the Services. If you are not willing to be bound by these terms and conditions, you should not select “ACCEPT,” and may not access or otherwise use the Pantas Service.

1. SERVICES

Each of the following products and services are referred to in this Agreement as a “Service” and together as the “Services”:

1.1 Pantas E-Invoicing and Financing Platform. Pantas E-Invoicing and Financing Platform is an online solution for businesses to send and receive invoices electronically, process payables, get paid and obtain financing from financial institutions.
1.2 Modification to Services. We have the right, in our sole discretion, to revise, update, or otherwise modify the Services or alter your access to the Services; and for material changes, to the extent reasonably possible, we will provide you with reasonable notice either posted on the website hosting the Services or to the Administrator’s (as defined below) email address. Note that we may modify the amount of storage space you have through the Services and the number of times (and the maximum duration for which) you may access the Services in a given period of time. In the event we need to maintain the security of the system or comply with any laws or regulations, we reserve the right to modify the Services immediately, and to provide the Administrator with electronic or written notice within thirty (30) days after any material modifications. You may reject any changes to the Services by discontinuing use of the Services to which such changes relate. Your continued use of the Services will constitute your acceptance of and agreement to such changes.

2. SUBSCRIPTIONS AND USERS

The Pantas Service is free unless specified otherwise. Pantas Software might offer a paid version with additional services, features and supports (“Pantas Premium Service”) that is licensed on a monthly or yearly subscription basis, as selected by you or your agent as the user.

3. FREE VERSION AND BETA FEATURES

If you registered for a free use of the Pantas Service, you can decide to purchase a license to the Pantas Premium Service when it is available.

From time to time, Pantas Software may, at its sole discretion, include new and/or updated beta features (“Beta Features”) in the Pantas Service for your use and which permit you to provide feedback (fees may apply). You understand and agree that your use of the Beta Features is voluntary and Pantas Software is not obligated to provide you with any Beta Features. You understand that once you use the Beta Features, you may be unable to revert back to the earlier non-beta version of the same or similar feature. Additionally, if such reversion is possible, you may not be able to return or restore data created within the Beta Feature back to the earlier non-beta version. The Beta Features are provided on an “as is” basis and may contain errors or inaccuracies that could cause failures, corruption or loss of data and/or information from any connected device. You acknowledge and agree that all use of the Beta Features is at your sole risk.

4. PERMITTED DISCLOSURES AND USE OF DATA

You acknowledge and agree that in order to provide you with access to and use of the Pantas Service, Pantas Software may provide your access information and account data to (i) your employee or agent who is identified in the registration data as the current system administrator for your account (the “Current Administrator”), and (ii) such other employee or agent who may be designated by you as a replacement administrator for the your account by following the procedures required by Pantas Software to effectuate such replacement. Any other person You identified as an authorized user of the Pantas Service will have access to the account data subject to the access permissions you or the system administrator assigned to them.

5. PERSONAL INFORMATION

5.1 Personal Information. You represent and warrant to us that:

5.1.1 You will provide appropriate notice and have obtained (or will obtain) all consents and rights necessary for us to Process the Personal Information in accordance with this Agreement and our Privacy Statement (Click here);
5.1.2 If you are providing Personal Information to us that is not personal to you, you agree that you have either provided the data subject notice or received permission from the data subject and have the appropriate legal basis, as required by applicable law, for us to: (a) use, and/or disclose the personal information in accordance with our Privacy Statement, (b) move the data outside of the country of residence of such owner of the personal data, if applicable, pursuant to our Privacy Statement, (c) provide the Personal Information to Third Party Products that you approve, and (d) otherwise use and disclose the personal information in accordance with this Agreement; and
5.1.3 If there is any discrepancy between this Agreement and the Pantas Software Privacy Statement with respect the collection, use, and/or disclosure of the personal information, the Privacy Statement will control. You further acknowledge and agree that Pantas Software may provide data in your account to any Additional Users to which that data is applicable or personal to.

5.2 Public Content.

As a User you may have the opportunity to share your data, Content, or ways in which you aggregate data (“Account Content”) with other Users, other Pantas Software customers, and other third parties. When sharing any Account Content, you agree not to share any confidential information. If you have the option of accessing another User’s Account Content, you understand and agree that the Account Content is being provided by the User, and not Pantas Software, for information and guidance purposes only, and Pantas Software and such User are not responsible in any way for your use the Account Content.

5.3 Telephone numbers.

You may provide us with your telephone number as part of your customer record or registration or via other methods. You understand and agree that Pantas Software may use your telephone number for "multi-factor authentication” (“MFA"), to confirm your identity and help protect the security of your account. Part of the MFA identity verification process may involve Pantas Software sending text messages containing security codes to your telephone number. You agree to receive these texts from Pantas Software containing security codes as part of the MFA process. In addition, you agree that Pantas Software may send automated text messages and pre-recorded voice messages to the telephone number you provide for other limited purposes, including: providing you with important critical notices regarding your use of the Services, or fulfilling a request made by you through the Services. Additionally, Pantas Software may use your telephone number to contact you about special offers or other Pantas Software or third-party products or services unless you opt out of such marketing. With MFA, you also agree and consent to us obtaining and using information from your mobile phone service provider, solely for the purposes of verifying your identity and to compare information you have provided to Pantas Software (such information may include from your mobile phone service provider account record: your name, address, email, customer type, customer role, billing type, mobile device identifiers (IMSI and IMEI) and other mobile phone subscriber details).

6. ACCESS TO YOUR FINANCIAL INSTITUTION SERVICES DATA

6.1. General. In connection with your use of the Pantas Service and as part of the functionality of certain versions of the Pantas Service, you may wish to have access to your online account(s) and financial information, including your account access number(s), password(s), security question(s) and answer(s), account number(s), login information, and any other security or access information used to access your financial institution(s) (collectively, your “FI Login Data”) and the data made available by your financial institutions(s) with such data, which may include bank balances, transaction activity, credit card charges, debits and deposits, and any messages or notices between you and the financial institution(s) (“FI Account Data”). The Pantas Service is designed to allow you to access and download your FI Account Data, to allow Pantas Software to access your financial institution account(s) using your FI Login Data, to allow Pantas Software to download and use your FI Account Data, and to allow Pantas Software to aggregate and combine your FI Account Data with other data. If you lose or forget your user name or password, it will be necessary for you to return to the appropriate financial institution if you have any problems with respect to that user name or password.

You acknowledge and agree that except as set forth this Agreement, Pantas Software has no control over your FI Login Data and no control over the access to your FI Account Data, does not guarantee that you will be able to use the Pantas Service with your financial institution(s), and will have no liability whatsoever for any actions or inactions on the part of the financial institution(s) resulting in your inability to use the Pantas Service to access your accounts, obtain data, download transactions, or otherwise use or access your FI Account Data.

6.2 Collection of FI Login Data and FI Account Data.

By agreeing to these terms and conditions, you:

6.2.1 acknowledge that in accessing your financial institution account(s) through the Pantas Service, your FI Login Data and FI Account Data may be collected, converted, stored in encrypted form and used by Pantas Software for the purpose of providing the Pantas Service;
6.2.2 authorize Pantas Software to (i) collect and store in encrypted form your FI Login Data, (ii) access the financial institution(s)’ websites using your FI Login Data, from time to time; (iii) download and store your FI Account Data; (iv) reformat and manipulate your FI Account Data; (v) create and provide hypertext links to your financial institution(s) FI Account Data; (vi) enhance the type of data and services we can provide to you in the future, and (vii) take such other actions as are reasonably necessary to perform the actions described in this Agreement as it relates to your use of Pantas Service;
6.2.3 hereby represent that the financial institution(s)’ account(s) and FI Login Data belong to you, you have the right to use the FI Login Data and FI Account Data as set out above and that you have the authority to appoint, and hereby expressly do appoint, Pantas Software as your agent with all necessary power and authority to use your FI Login Data and to access and retrieve your FI Account Data, as described above, on your behalf;
6.2.4 acknowledge that Pantas Software does not review your FI Account Data and agree that Pantas Software is not responsible for its completeness or accuracy;
6.2.5 acknowledge that any transactions or informational activities performed at any financial institution(s)’ website are not made through the Pantas Service and Pantas Software assumes no responsibility for any such transactions or activities; and
6.2.6 acknowledge that you are solely responsible for any charges, fees or costs associated with your financial institution account(s) when accessed through the Pantas Service by you or by Pantas Software.

6.3. Information from Financial Institutions’ Websites.

You acknowledge that (i) some financial institution(s) may not permit Pantas Software or other third parties to have access to FI Login Data or to allow the Pantas Service to access your FI Account Data; (ii) financial institution(s) may make changes to their websites, with or without notice to you or Pantas Software, that may affect the overall performance of the Pantas Service and prevent or delay aggregation of data from such websites; and (iii) the Pantas Service refreshes your Pantas Service account data by collecting the FI Account Data automatically or manually (depending on your financial institution(s) or any changes by you that may require an update), so your most recent transactions may not always be reflected in the account balances or other account information presented to you by Pantas Software through the Pantas Service. If you see a discrepancy in your Pantas Service account data as compared to your FI Account Data, and in any case before making any transactions or decisions based on such account data presented in the Pantas Service, you should check the last refresh date for your financial institution account(s) and confirm the accuracy of the Pantas Service account data against your FI Account Data and manually update such data as necessary.

7. ONLINE DATA TRANSFER

You may have the option for Pantas Software to transfer your data files from the Pantas Service in order to facilitate certain interoperability, data integration, and data access between the Pantas Service and certain supported ancillary services (the “Ancillary Services”) you may sign up for and use in connection with the Pantas Service (the “Online Data Transfer”). In order for you to select the Online Data Transfer option, you must (i) have registered select versions of the Pantas Service, (ii) have Internet access, (iii) have an active subscription or access to the Pantas Service; and (iv) and may need to be an active subscriber to the Ancillary Services. If you select the Online Data Transfer option, a copy of all or part of your company data files will be transferred via the Internet to Pantas Software’s servers; where you grant Pantas Software the right and license to (i) host and maintain your data, (ii) use and transfer your data to the Ancillary Services and (iii) reformat and manipulate your data as reasonably necessary for the data to function with the Ancillary Services. Your original data files will remain in the Pantas Service. If you sign up for any Ancillary Services that support Online Data Transfer, you will have the option to request that Pantas Software send your data to any of those supported Ancillary Services. If a supported Ancillary Service is provided by a third party, you authorize Pantas Software to transfer your data to and from the third-party provider to enable provision of the Ancillary Services to you. Pantas Software will support and maintain the data transfer service as part of the Pantas Service. You agree that the third-party provider may transfer your data from the Ancillary Service to Pantas Software, and that, Pantas Software may use such data subject to the terms of this Agreement. You agree and acknowledge that Pantas Software has no control over any third-party provider or any third-party Ancillary Services. Your use of the Ancillary Service is subject to additional third-party terms and conditions. Please carefully review their terms and conditions, including privacy policy. If you do not agree with their terms and policies, you should not use or access the third party Ancillary Service and you should not authorize the Online Data Transfer to the third party Ancillary Service.

8. PANTAS SERVICE USE, STORAGE AND ACCESS

Pantas Software shall have the right, in its sole discretion and with reasonable notice posted on the Pantas Service site and/or sent to you at the Current Administrator’s email address provided in the Registration Data, to revise, update, or otherwise modify the Pantas Service and establish or change limits concerning use of the Pantas Service, temporarily or permanently, including but not limited to (i) the amount of storage space you have on the Pantas Service at any time, and (ii) the number of times (and the maximum duration for which) you may access the Pantas Service in a given period of time. Pantas Software reserves the right to make any such changes effective immediately to maintain the security of the system or User Access Information or to comply with any laws or regulations, and to provide you with electronic or written notice within sixty (60) days after such change. You may reject changes by discontinuing use of the Pantas Service to which such changes relate. Your continued use of the Pantas Service will constitute your acceptance of and agreement to such changes. Pantas Software may, from time to time, perform maintenance upon the Pantas Service resulting in interrupted service, delays or errors in the Pantas Service. Pantas Software will attempt to provide prior notice of scheduled maintenance but cannot guarantee that such notice will be provided.

9. CANCELLATION

Upon cancellation of the Pantas Service (free version), you will not have any access to the Pantas Service. Please follow product instructions to cancel your account.

Upon cancellation of the Pantas Premium Service, you will be able to access the Pantas Service only through the end of the subscription term, as specified in the product or product program pages. After the subscription term ends, you will not have any access to the Pantas Premium Service. There are no refunds upon cancellation. Please follow product instructions to cancel your account.

10. SOCIAL MEDIA SITES

Pantas Software may provide experiences on social media platforms such as Facebook®, Twitter® and LinkedIn® that enable online sharing and collaboration among anyone who has registered to use them. Any content you post, such as pictures, information, opinions, or any Personal Information that you make available to other participants on these social platforms, is subject to the Terms of Use and Privacy Policies of those platforms. Please refer to those social media platforms to better understand your rights and obligations with regard to such content.

11. THIRD PARTY PRODUCTS AND SERVICES

Pantas Software may tell you about third party products or services, including via the Service. Pantas Software may offer products and services on behalf of third parties who are not affiliated with Pantas Software (“Third Party Products”) and/or provide access or links to third party websites ("Third Party Sites"). If you decide to use any Third Party Products or access any Third Party Sites, you are solely responsible for your selection, review of separate product terms, website terms and privacy policies. Pantas Software is not affiliated with these Third Party Products or Third Party Sites and does not endorse or recommend Third Party Products even if such products are marketed or distributed via our products, website or associated with Pantas Software in any way. You agree that the third parties, and not Pantas Software, are solely responsible for the Third Party Product’s performance (including technical support), the content on their websites and their use or disclosure of your data. Pantas Software will not be liable for any damages, claims or liabilities arising from the third parties, Third Party Products or Third Party Sites.

You agree that you will (i) comply with all applicable laws, regulation and ordinances; (ii) not use the Third Party Products in any manner that would infringe or violate the rights of Pantas Software or any other party; and (iii) not use the Third Party Products in any way in furtherance of criminal, fraudulent or other unlawful activity.

12. APPLE REQUIREMENTS

If you downloaded the Software from the Mac App Store, the following terms also apply to you:

Acknowledgement: You acknowledge that this Agreement is between you and Pantas Software only, and not with Apple, and Pantas Software, not Apple, is solely responsible for the Software and the content thereof.
Scope of License: The license granted to you for the Software is a limited, non-transferable license to use the Software on Mac product that you own or control and as permitted by the Usage Rules set forth in the terms of service applicable to the Mac App Store.
Maintenance and Support: Pantas Software and not Apple is solely responsible for providing any maintenance and support services, for which additional fees may apply, with respect to the Services. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Software.
Warranty: Pantas Software is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Software to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Software, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Pantas Software’s sole responsibility.
Product Claims: Pantas Software, not Apple, is responsible for addressing any user or third party claims relating to the Software or the user’s possession and/or use of the Software, including, but not limited to: (i) product liability claims; (ii) any claim that the Software fail to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
Intellectual Property Rights: You acknowledge that, in the event of any third party claim that the Software or your possession and use of the Software infringes that third party’s intellectual property rights, Pantas Software, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a terrorist-supporting country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third Party Terms of Agreement: You must comply with any applicable third party terms of agreement when using the Software.
Third Party Beneficiary: You acknowledge and agree that Apple and Apple’s subsidiaries are third party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of the Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce the Agreement against you as a third party beneficiary thereof.

13. GOVERNING LAW AND JURISDICTION

The validity, construction and performance of this Agreement will be governed by and construed in accordance with the laws of Malaysia. Any dispute, controversy or claim arising out of or relating to this Agreement or breach thereof, shall be settled by arbitration in accordance with the Asian International Arbitration Centre (“AIAC”) Arbitration Rules. The place of arbitration shall be in Kuala Lumpur, Malaysia, and all proceedings, including required notices and requests to the Parties shall be in conducted in the English language. Each Party may select its own counsel to participate on its behalf. The award by the arbitrator shall be final and binding on the Parties, and each Party hereby waives to the fullest extent permitted by law any right it may otherwise have under the laws of any jurisdiction to any form of appeal. Each Party will be responsible for its own costs of arbitration.

1. Introduction

1.1 PANTAS SOFTWARE SDN. BHD. ("Pantas" or "we" or "our" or "us") recognises and undertakes its responsibilities under the Personal Data Protection Act 2010 ("PDPA"). We recognize the importance of the personal data you have entrusted to us and believe that it is our responsibility and commitment to properly manage, protect and process your personal data.
1.2 Please read this Data Protection and Privacy Policy ("policy") to understand what personal data is collected or processed by us, and for what purposes it is used for, how we handle, collect, use, disclose and process personal data about you that you give us, or receive through third parties or that is in our possession.
1.3 By providing your personal data to us, you acknowledge and agree that you have fully read and understood this policy, and are consenting to the collection, use, processing and disclosure of your personal data as described in this policy. 2. Definition of Data Protection Terms

Employees of data users are excluded from this definition, but it could include suppliers which handle personal data on behalf of Pantas.
2.3 Data subject means an individual who is the subject of the personal data.
2.4 Data user means a person who either alone or jointly in common with other persons processes any personal data or has control over or authorizes the processing of any personal data, but does not include a data processor.
2.5 Personal data means any data relating to an individual who can be identified from that data or from that data and other information to which we have or may have access to. Personal data can be factual (such as a name, address or date of birth) or it can be an opinion (such as a product review). It can even include a simple e-mail address. It is important that the information has the data subject as its focus and affects the individual's privacy in some way.
2.6 Processing is any activity that involves use of the data. It includes collecting, recording, holding or storing the data, or carrying out any operation or set of operations on the data including organising, adapting, altering, retrieving, consulting, using, disclosing, making available, aligning, combining, correcting, erasing or destroying it. Processing also includes transferring personal data to third parties.

3. Types of Personal Data We Collect

5.2 We may/will need to disclose your personal data to third parties, including to banks, credit bureaus, payment service providers and/or other payment gateways, whether located within or outside Malaysia, for one or more of the above Purposes, as such third parties would be processing your personal data for one or more of the above Purposes. In this regard, you hereby acknowledge, agree and consent that we may/are permitted to disclose your personal data to such third parties (whether located within or outside Malaysia) for one or more of the above Purposes and for the said third parties to subsequently collect, use, disclose and/or process your personal data for or more of the above Purposes. Without limiting the generality of the foregoing, such third parties include:
1. our associated/affiliated organisations or related corporations;

5.3 We may share your personal data with any member of our group (which means our subsidiaries, our ultimate holding company and its subsidiaries) from time to time for one or more of the Purposes.
5.4 You may withdraw your consent for the collection, use and/or disclosure of your personal data in our possession or under our control by contacting our Data Protection Officer. However, your withdrawal of consent could result in certain legal consequences arising from such withdrawal, including us being unable to perform the transactions requested by you on our website(s) or website/IT portal(s)/mobile application(s). Please note that your withdrawal of consent will not affect our ability to collect, use or disclose your personal data for a specific purpose without your consent, if the PDPA or a provision in applicable law permits us to.
5.5 We may collect, use, disclose or process your personal data for other purposes that do not appear above. However, we will notify you of such other purposes at the time of obtaining your consent, unless processing of your personal data without your consent is permitted by the PDPA or by law.
5.6 We may/will also be collecting from sources other than yourself, personal data about you, for one or more of the above Purposes, and thereafter using, disclosing and/or processing such personal data for one or more of the above Purposes. We may combine information we receive from other sources with information you give to us and information we collect about you. We may use this information and the combined information for the Purposes set out above (depending on the types of information we receive).
5.7 We will not share information on invoices created, received or stored on Pantas such as item description, item price, quantity, etc., with other users or third parties.

6. Accuracy of Personal Data

By providing us with your personal data, you warrant that it is true and accurate and undertake to notify us as soon as practicable of any change or alteration to the same. Any loss or damage caused by the provision of erroneous, inexact or incomplete information will be your exclusive and absolute responsibility.

7. Storage of Personal Data

7.1 Security of your personal data is important to us. We take appropriate action to protect personal data from loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or destruction using the same safeguards as we use for our own proprietary information. All information you provide to us is stored on secure servers and any payment transactions will be encrypted using SSL technology. However, while we try to safeguard your personal data, we cannot assure or warrant the safety of any data that you give us, and you do so at your own risk. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our website(s) or website/IT portal(s)/mobile application(s), you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
7.2 We will put in place measures such that your personal data in our possession or under our control is destroyed and/or anonymized as soon as it is reasonable to assume that:
1. the purpose for which that personal data was collected is no longer being served by the retention of such personal data; and
2. retention is no longer necessary for any other legal or business purposes.

8. Transfer of Personal Data to places outside Malaysia

Your personal data may be transferred across borders by us. Your personal data may be transferred with any member of our group (as defined in Clause 5.3) located in different countries. If you opt to enter into a contract with a third party through our website(s), website/IT portal(s)/mobile application(s) and other digital and telecommunication channels, the data you provide to us, along with any other information requested and provided by you or us to the third party are controlled by the third party in accordance with that third party provider's privacy policy. We are not responsible for the privacy policies or levels of compliance of third parties or for how third party providers use your personal data. Furthermore, we do not endorse the practices and content of any third party websites.

10. Withdrawal of Consent for Marketing Purposes

You have the right to ask us not to use your personal data for marketing purposes. If you no longer wish to receive marketing messages from us, you may request to withdraw your consent by emailing or writing to our Data Protection Officer, or if applicable, using the unsubscribe facility contained in the marketing message.

11. Data Access and Correction

11.1 You have the right to access and/or correct any personal data that we hold about you, subject to the requirements of the PDPA. If you would like to request for a copy of your personal data being held by us (such right being subject to applicable exemptions), or to update and/or correct the personal data which you have previously provided to us, please contact our Data Protection Officer.

11.2 We will need enough information from you in order to ascertain your identity as well as the nature of your request, so as to be able to deal with your request. We reserve the right, or may, charge a reasonable fee for the processing of any data access request.
11.3 For a request to access personal data, we will seek to provide you with the relevant personal data within 21 days from the date of receipt of your request. Where we are unable to respond to you within the said 21 days, we will notify you of the following in writing:
1. that we are unable to comply in full with your request within the 21-day period;
2. the reason(s) why we are unable to do so;
3. the extent to which we are able to comply with your request; and
4. the soonest possible time within which we can provide you with the information requested.

Data Correction Request

11.4 For a request to correct personal data, once we have sufficient information from you to deal with the request, we will correct your personal data within 21 days from the date of receipt of your request and supply you with a copy of the personal data as corrected. Where we are unable to do so within the said 21 days, we will notify you of the following in writing:
1. that we are unable to comply in full with your request within the 21-day period;
2. the reason(s) why we are unable to do so;
3. the extent to which we are able to comply with your request; and
4. the soonest practicable time within which we can make the correction.
11.5 Note that the PDPA exempts certain types of personal data from being subject to your correction request as well as provides for situation(s) when correction needs not be made by us despite your request. Where this is the case, we shall, not later than 21 days from the date of receipt of your request, notify you of the following in writing:
1. that we are refusing to comply with your data correction request;
2. the reason(s) for the refusal; and
3. where the reason for the refusal is that another data user controls the processing of the personal data to which your data correction request relates, such that we are unable to comply with your request, the name and address of the other data user concerned.
11.6 We will send the corrected personal data to every other organisation to which the personal data was disclosed by us within a year before the date the correction was made, unless we believe that that other organisation has ceased using the personal data for the purpose for which the personal data was disclosed to the third party.

12. Complaint Process

12.1 If you have any complaint or grievance regarding how we are handling your personal data or about how we are complying with the PDPA, we welcome you to contact us with your complaint or grievance by writing to our Data Protection Officer.
12.2 Where you are sending an email in which you are submitting a complaint, your indication at the subject header that it is a PDPA complaint would assist us in attending to your complaint speedily by passing it on to the relevant staff in our organisation to handle. For example, you could insert the subject header as "PDPA Complaint".
12.3 We will certainly strive to deal with any complaint or grievance that you may have speedily and fairly.

13. General

13.1 Your consent that is given pursuant to this Privacy Policy is additional to and does not supersede any other consents that you had provided to us with regard to processing of your personal data.
13.2 For the avoidance of doubt, in the event that Malaysian personal data protection law permits an organisation such as us to collect, use or disclose your personal data without your consent, such permission granted by the law shall continue to apply.

1. Pengenalan

1.1 PANTAS SOFTWARE SDN. BHD. ("Pantas" atau "kami") mengiktiraf dan melaksanakan tanggungjawabnya di bawah Akta Perlindungan Data Peribadi 2010 ("APDP"). Kami mengiktiraf kepentingan data peribadi yang anda meletakkan kepercayaan kepada kami dan mempercayai bahawa itu adalah tanggungjawab dan komitmen kami untuk menguruskan, melindungi dan memproses data peribadi anda dengan betul.
1.2 Sila baca Dasar Perlindungan Data dan Privasi ("dasar") untuk memahami jenis data peribadi yang dikumpulkan atau diproses oleh kami, dan untuk tujuan apa ia digunakan, cara kami mengendalikan, mengumpul, mengguna, mendedah dan memproses data peribadi mengenai anda yang anda berikan kepada kami, atau diterima melalui pihak ketiga atau yang dimiliki oleh kami.
1.3 Dengan menyediakan data peribadi anda kepada kami, anda mengakui dan bersetuju bahawa anda telah membaca dan memahami sepenuhnya dasar ini, dan mengizinkan pengumpulan, penggunaan, pemprosesan dan pendedahan data peribadi anda seperti yang dijelaskan dalam dasar ini. 1.5 Sekiranya berlaku sebarang konflik, perchanggahan atau ketaktekalan antara dasar versi bahasa Inggeris dan dasar versi bahasa Melayu, dasar versi bahasa Inggeris akan digunakan.

2. Definisi Takrif Perlindungan Data

2.1 Data merupakan maklumat yang direkodkan sama ada tersimpan secara elektronik, pada komputer, atau dalam sistem pemfailan berasaskan kertas tertentu.
2.2 Pemproses data termasuk sesiapa sahaja yang memproses data peribadi semata-mata bagi pihak pengguna data dan tidak memproses data peribadi untuk tujuannya sendiri. Kakitangan untuk pengguna data dikecualikan daripada takrif ini, tetapi boleh termasuk pembekal yang mengendalikan data peribadi bagi pihak Pantas.
2.3 Subjek data ertinya seseorang individu yang menjadi subjek data peribadi itu.
2.4 Pengguna data ertinya seseorang yang sama ada berseorangan atau bersesama atau bersama dengan orang lain memproses apa-apa data peribadi atau mempunyai kawalan terhadap atau membenarkan pemprosesan apa-apa data peribadi, tetapi tidak termasuk seorang pemproses data.
2.5 Data peribadi bermaksud apa-apa data yang berkaitan dengan individu yang boleh dikenal pasti daripada data itu atau dari data dan maklumat lain yang kami ada atau mungkin mempunyai akses padanya. Data peribadi boleh merupakan fakta (seperti nama, alamat atau tarikh lahir) atau ia boleh merupakan suatu pendapat (seperti ulasan produk). Ini juga boleh termasuk alamat e-mel yang mudah. Adalah penting bahawa maklumat mempunyai subjek data kerana ia memberi tumpuan dan mempengaruhi privasi seseorang dalam beberapa cara.
2.6 Pemprosesan adalah sebarang aktiviti yang melibatkan penggunaan data. Ia termasuk mengumpul, merekod, memegang atau menyimpan data, atau menjalankan sebarang operasi atau set operasi pada data termasuk mengatur, menyesuai, mengubah, mengambil, merunding, mengguna, mendedah, membuatnya tersedia, menyelaras, menggabung, membetulkan, memadam atau memusnahkannya. Pemprosesan juga termasuk memindahkan data peribadi kepada pihak ketiga.

3. Jenis- Jenis Data Peribadi yang Kami Kumpulkan

3.1 Kami mengumpul maklumat tentang anda apabila anda menggunakan laman web kami, aplikasi laman web/portal IT/mudah alih, borang, tinjauan, dan/atau saluran-saluran lain dan sepanjang interaksi, komunikasi dan perkhidmatan lain yang anda ada bersama kami.
3.2 Data peribadi yang mungkin kami kumpulkan termasuk tetapi tidak terhad kepada:
1. maklumat peribadi anda seperti nama anda, salinan Kad pengenalan/ Pasport, tarikh lahir, status perkahwinan, jantina;
2. maklumat hubungan anda seperti alamat kediaman atau pos, alamat e-mel, nombor-nombor telefon, telefon mudah alih dan faks;
3. maklumat pekerjaan anda yang lalu dan sekarang seperti nama organisasi, jenis organisasi, sektor industri, fungsi pekerjaan dan tanggungjawab, jawatan, nombor-nombor telefon perniagaan dan faks, alamat e-mel perniagaan; dan
4. maklumat bil dan pembayaran anda, termasuk nama pemegang kad kredit/debit, nombor kad kredit/debit, kod keselamatan dan tarikh luput.
5. maklumat lain yang perlu dikumpul untuk acara, kempen, borang, ciri atau servis yang digunakan atau diminta oleh anda.
3.3 Maklumat lain yang dikumpulkan mungkin termasuk bukti pendapatan dan butiran kewangan, gambar, video dan/atau rakaman audio yang dikumpulkan daripada kami melalui atas talian (laman web, e-mel, aplikasi, dll.) Atau platform luar talian (acara, tinjauan, panggilan telefon, dan sebagainya).
3.4 Kami boleh mengumpul dan menyimpan maklumat tertentu secara automatik apabila anda melawat laman web kami atau menggunakan aplikasi laman web/ portal IT/mudah alih kami. Contohnya termasuk alamat protokol internet (IP) yang digunakan untuk menyambungkan komputer atau peranti anda ke Internet, maklumat sambungan seperti jenis dan versi pelayar, sistem operasi dan platform anda, nombor rujukan unik yang berkaitan dengan data yang anda masukkan pada sistem kami, butiran log masuk, klik strim URL penuh pada, melalui dan dari laman web atau aplikasi laman web/portal IT/mudah alih (termasuk tarikh dan masa), pengecam kuki dan aktiviti anda di laman web atau aplikasi laman web/ portal IT/mudah alih kami, termasuk halaman yang anda lawati, carian yang anda lakukan dan, jika berkaitan, perkhidmatan yang anda beli.
3.5 Kami mungkin menerima maklumat tentang anda daripada pihak ketiga jika anda menggunakan mana-mana laman web atau platform media sosial yang dikendalikan oleh pihak ketiga (misalnya, Facebook, Instagram, Twitter dll.) dan jika fungsi tersebut tersedia, anda telah memilih untuk memautkan profil anda di laman web kami atau aplikasi laman web/ portal IT/ mudah alih dengan profil anda di laman web atau platform media sosial yang lain.

4. Kuki

4.1 Kami menggunakan kuki untuk mengenal pasti anda daripada pengguna lain di laman web kami atau aplikasi laman web/portal IT/ mudah alih.
4.2 Kuki ialah fail kecil yang mengandungi huruf dan nombor yang kami simpan pada pelayar anda atau pemacu keras komputer atau peranti anda.
4.3 Anda boleh menyekat atau menyahaktifkan kuki dalam tetapan pelayar anda.
4.4 Kami menggunakan kuki log-masuk untuk mengingati anda semasa anda melog masuk untuk kelancaran pengalaman.
4.5 Kami menggunakan kuki sesi untuk menjejak pergerakan anda dari halaman ke halaman lain dan untuk menyimpan input terpilih anda supaya anda tidak sentiasa diminta untuk maklumat yang sama.
4.6 Dengan terus menggunakan laman web kami atau aplikasi laman web/portal IT/mudah alih, anda bersetuju untuk menggunakan kuki di laman web seperti yang digariskan di atas. Walau bagaimanapun, sila ambil perhatian bahawa kami tidak mempunyai kawalan ke atas kuki yang digunakan oleh pihak ketiga.

5. Tujuan untuk Data Peribadi Dikumpulkan, Digunakan dan Didedahkan

5.1 Kami akan/mungkin mengumpul, mengguna, mendedah dan/atau memproses data peribadi anda untuk satu atau lebih daripada tujuan berikut:
1. Untuk mempertimbang dan/atau memproses permohonan anda untuk menjadi pelanggan /pengguna kami dan/atau memproses akaun anda dengan kami;
2. Untuk memudahkan, memproses, mengurus dan/atau mentadbir akaun anda bersama kami;
3. Untuk pembekalan apa-apa barangan dan/atau perkhidmatan yang kami tawarkan kepada anda atau yang anda boleh meminta, mendapatkan atau membeli daripada kami;
4. Untuk mengurus, memproses dan/atau mentadbir penggunaan perkhidmatan atas talian anda di mana-mana laman web kami, aplikasi laman web/portal IT/mudah alih dan/atau melalui saluran digital atau telekomunikasi yang lain;
5. Untuk tujuan pengenalpastian dan pengesahan berkaitan dengan mana-mana barangan dan/atau perkhidmatan yang mungkin dibekalkan kepada anda oleh kami atau yang anda boleh memintanya daripada kami;
6. Untuk melaksanakan arahan anda, memberi maklum balas kepada sebarang pertanyaan atau berurusan dengan sebarang maklum balas yang diberikan oleh (atau bermaksud diberikan oleh) anda atau bagi pihak anda, termasuk menghubungi anda melalui panggilan telefon/suara, mesej teks dan/atau faks, e-mel dan/atau mel pos mengenai arahan, pertanyaan dan/atau maklum balas anda;
7. Untuk menjalankan aktiviti penyelidikan, analisis dan pembangunan (termasuk tetapi tidak terhad kepada analitik data, tinjauan, kumpulan fokus dan/atau pemprofilan) untuk meningkatkan perkhidmatan dan kemudahan kami untuk manfaat anda, atau untuk memperbaiki mana-mana program atau acara pemasaran kami;
8. Untuk mengurus, memproses dan/atau mentadbir kempen pemasaran yang dijalankan oleh kami atau bagi pihak kami yang mana anda sudah memberi keizinan untuk mengambil bahagian;
9. Untuk menghubungi anda atau berkomunikasi dengan anda melalui berbilang mod komunikasi seperti panggilan telefon/suara, mesej teks dan/atau mesej faks, borang, e-mel dan/atau mel pos untuk tujuan mentadbir, mengurus dengannya dan/atau menguruskan akaun anda dengan kami. Anda mengakui dan bersetuju bahawa komunikasi sedemikian oleh kami boleh melalui surat-menyurat, dokumen atau notis kepada anda, yang mungkin melibatkan pendedahan data peribadi tertentu tentang anda untuk membawa penyampaian yang sama serta pada penutup luaran sampul/pakej mel;
10. Untuk menjalankan aktiviti usaha wajar atau pemeriksaan lain (termasuk kredit, pemeriksaan keselamatan dan latar belakang) mengikut kewajipan undang-undang atau pengawalseliaan atau prosedur pengurusan risiko yang mungkin diperlukan oleh undang-undang atau yang mungkin telah disediakan oleh kami;
11. Untuk mencegah atau menyiasat sebarang penipuan, aktiviti yang menyalahi undang-undang atau peninggalan atau salah laku, sama ada atau tidak ada yang disyaki yang disebutkan atau tidak; berurusan dengan dan/atau menyiasat aduan;
12. Untuk mematuhi atau sebagaimana yang dikehendaki oleh mana-mana undang-undang yang terpakai, keperluan kerajaan atau pengawalseliaan untuk mana-mana bidang kuasa yang terpakai kepada kami atau syarikat gabungan/bersekutu kami, termasuk memenuhi keperluan untuk membuat pendedahan di bawah keperluan mana-mana undang-undang yang mengikat kami atau syarikat gabungan/bersekutu kami, dan/atau untuk tujuan mana-mana garis panduan yang dikeluarkan oleh pengawal selia atau pihak berkuasa lain (sama ada dari Malaysia atau tempat lain), yang mana kami atau syarikat gabungan/ bersekutu dijangka untuk mematuhinya;
13. Untuk mematuhi atau sebagaimana yang dikehendaki oleh sebarang permintaan atau arahan mana-mana pihak berkuasa kerajaan; atau memberi respons kepada permintaan maklumat daripada hospital, kedutaan, agensi awam, kementerian, lembaga berkanun atau pihak berkuasa yang serupa;
14. Untuk tujuan pemasaran apabila kami menghantar berita, maklumat, bahan dan/atau kemas kini mengenai acara, kempen pemasaran, produk dan/atau perkhidmatan yang kami dan/atau rakan kongsi perniagaan kami sediakan, atau bagi pihak kami. Dalam perkara ini, kami akan melakukannya melalui mel pos dan/atau penghantaran elektronik ke alamat e-mel anda. Anda boleh berhenti melanggan perkhidmatan ini mengikut cara yang dinyatakan dalam Klausa 10 di bawah;
15. Untuk memudahkan dan/atau berurusan dengan pembayaran bagi barangan dan/atau perkhidmatan yang disediakan oleh kami atau anak syarikat kami, dan/atau pihak ketiga bagi pihak kami termasuk pengesahan butiran kad kredit dengan pihak ketiga dan tambahan lagi, menggunakan data peribadi yang anda berikan untuk menjalankan prosedur pemadanan terhadap pangkalan data urusniaga palsu yang diketahui (diselenggara oleh kami atau pihak ketiga);
16. Untuk menguruskan, mengendali dan/atau menjalankan proses, perkara dan/atau pengaturan tatatertib, keselamatan dan jaminan kualiti;
17. Untuk melaksanakan tugasan pentadbiran, operasi dan teknologi dalaman untuk memudahkan, mentadbir atau menguruskan akaun anda dengan kami;
18. Untuk menghasilkan statistik dan penyelidikan untuk pelaporan dalaman dan/atau undang-undang dan/atau keperluan penyimpanan rekod dan melaksanakan semakan semula dasar/proses kami;
19. Untuk mendedahkan kepada pihak ketiga bagi mematuhi sebarang undang-undang, keperluan perundangan, perintah, arahan atau permintaan daripada mana-mana mahkamah, pihak berkuasa atau badan kerajaan untuk mana-mana bidang kuasa, yang mungkin berada di dalam atau di luar Malaysia;
20. Untuk membantu kami meningkatkan perkhidmatan kami kepada anda; dan/atau
21. Untuk menyimpan, menghantar, menyandarkan (sama ada untuk pemulihan bencana atau sebaliknya) data peribadi anda, sama ada di dalam atau di luar Malaysia.
5.2 Kami mungkin/akan perlu mendedahkan data peribadi anda kepada pihak ketiga, termasuk kepada bank, biro kredit, penyedia perkhidmatan pembayaran dan/atau gerbang pembayaran lain, sama ada terletak di dalam atau di luar Malaysia, untuk satu atau lebih Tujuan di atas, oleh sebab pihak ketiga tersebut akan akan memproses data peribadi anda untuk satu atau lebih Tujuan di atas. Dalam perkara ini, anda dengan ini mengakui, bersetuju dan memberi keizinan bahawa kami boleh/dibenarkan untuk mendedahkan data peribadi anda kepada pihak ketiga tersebut (sama ada terletak di dalam atau di luar Malaysia) untuk satu atau lebih Tujuan di atas dan bagi pihak ketiga tersebut untuk seterusnya mengumpul, menggunakan, mendedahkan dan/atau memproses data peribadi anda untuk atau lebih daripada Tujuan di atas. Tanpa mengehadkan keluasan makna yang disebut terdahulu, pihak ketiga tersebut termasuk:
1. pertubuhan berkaitan/ gabungan atau syarikat berkaitan kami;
2. mana-mana rakan kerjasama, ejen, kontraktor atau penyedia perkhidmatan pihak ketiga yang memproses atau akan memproses data peribadi anda bagi pihak kami termasuk tetapi tidak terhad kepada mereka yang menyediakan perkhidmatan pentadbiran atau perkhidmatan lain kepada kami seperti biro-biro kredit, rumah mel, syarikat telekomunikasi, syarikat teknologi maklumat syarikat dan pusat data; dan
3. pihak ketiga yang kami dedahkan adalah untuk satu atau lebih Tujuan dan pihak ketiga tersebut akan mengumpul dan memproses data peribadi anda untuk satu atau lebih Tujuan.

5.3 Kami mungkin berkongsi maklumat anda dengan mana-mana ahli kumpulan kami (yang bermaksud anak-anak syarikat kami, syarikat induk utama kami dan anak-anak syarikatnya) dari masa ke semasa untuk satu atau lebih Tujuan.
5.4 Anda boleh menarik balik keizinan anda untuk pengumpulan, penggunaan dan/atau pendedahan data peribadi anda dalam pemilikan kami atau di bawah kawalan kami dengan menghubungi Pegawai Perlindungan Data kami. Walau bagaimanapun, penarikan keizinan anda boleh menyebabkan akibat undang-undang tertentu timbul daripada penarikan tersebut, termasuk kami yang tidak dapat melakukan urus niaga yang anda minta pada laman web kami atau aplikasi laman web/portal IT/mudah alih. Sila ambil perhatian bahawa penarikan keizinan anda tidak akan menjejaskan kebolehan kami untuk mengumpul, menggunakan atau mendedahkan data peribadi anda untuk tujuan tertentu tanpa persetujuan anda, jika APDP atau peruntukan dalam undang-undang yang berkenaan membenarkan kami.
5.5 Kami mungkin mengumpul, mengguna, mendedah atau memproses data peribadi anda untuk tujuan lain yang tidak dinyatakan di atas. Walau bagaimanapun, kami akan memaklumkan anda tentang tujuan lain pada masa mendapatkan persetujuan anda, melainkan pemprosesan data peribadi anda tanpa persetujuan anda dibenarkan oleh APDP atau oleh undang-undang.
5.6 Kami juga mungkin/akan mengumpul daripada sumber-sumber selain daripada diri anda, data peribadi mengenai anda, untuk satu atau lebih Tujuan di atas, dan selepas itu mengguna, mendedah dan/atau memproses data peribadi tersebut untuk satu atau lebih Tujuan di atas. Kami mungkin menggabungkan maklumat yang kami terima daripada sumber lain dengan maklumat yang anda berikan kepada kami dan maklumat yang kami kumpulkan mengenai anda. Kami mungkin menggunakan maklumat ini dan maklumat gabungan untuk Tujuan yang dinyatakan di atas (bergantung kepada jenis maklumat yang kami terima).
5.7 Kami tidak akan berkongsi maklumat mengenai invois seperti keterangan barang, harga barang, bilangan barang dan lain-lain, dengan pengguna lain atau pihak ketiga.

6. Ketepatan Data Peribadi

Anda bersetuju bahawa data peribadi anda yang berikan kepada kami adalah tepat, lengkap, tidak mengelirukan dan terkini, dan akan memaklumkan kami secepat mungkin jika terdapat sebarang perubahan kepada maklumat peribadi anda yang kami pegang. Sebarang kerugian atau kerosakan yang disebabkan oleh penyediaan maklumat yang salah, tidak tepat atau tidak lengkap akan menjadi tanggungjawab eksklusif dan mutlak anda.

7. Penyimpanan Data Peribadi

7.1 Keselamatan data peribadi anda penting bagi kami. Kami mengambil tindakan sewajarnya untuk melindungi data peribadi daripada hilang, salah guna, pengubahsuaian, akses atau pendedahan tanpa izin atau tidak disengajakan, pengubahan atau pemusnahan menggunakan perlindungan yang sama seperti yang kami gunakan untuk maklumat proprietari kami sendiri. Semua maklumat yang anda berikan kepada kami disimpan pada pelayan selamat dan sebarang urus niaga pembayaran akan disulitkan menggunakan teknologi SSL. Sekiranya kami telah memberikan anda dengan (atau sekiranya anda telah memilih) kata laluan yang membolehkan anda mengakses bahagian tertentu laman web atau aplikasi laman web/portal IT/ mudah alih kami, anda bertanggungjawab untuk memastikan kata laluan ini dirahsiakan. Kami meminta anda untuk tidak berkongsi kata laluan dengan sesiapa pun.
7.2 Kami akan meletakkan langkah-langkah sedemikian supaya data peribadi anda dalam pemilikan kami atau di bawah kawalan kami dimusnahkan dan/atau tanpa nama apabila munasabah untuk mengandaikan bahawa:
1. tujuan yang mana data peribadi itu dikumpulkan tidak lagi diperlukan oleh pengekalan data peribadi itu; dan
2. pengekalan tidak lagi diperlukan untuk sebarang tujuan undang-undang atau perniagaan yang lain.

8. Pemindahan Data Peribadi ke lokasi di luar Malaysia

Data peribadi anda mungkin dipindahkan melintasi sempadan oleh kami. Data peribadi anda mungkin dipindahkan dengan mana-mana ahli kumpulan kami (seperti yang ditentukan dalam Klausa 5.3) yang terletak di negara yang berbeza. Kami akan mengambil langkah yang sewajarnya untuk menjaga keselamatan data peribadi baik ketika transit mahupun di lokasi penerimaan. Kami akan berusaha untuk memastikan bahawa negara tempat data peribadi anda dipindahkan mempunyai undang-undang perlindungan data peribadi yang serupa atau setara.

9. Pautan ke Laman Web Lain

Laman web, aplikasi laman web/portal IT/mudah alih dan saluran digital dan telekomunikasi lain mungkin mengandungi pautan ke laman lain yang dikendalikan oleh syarikat pihak ketiga dengan amalan privasi yang berbeza. Sekiranya anda memilih untuk membuat kontrak dengan pihak ketiga melalui laman web, laman web / portal IT / aplikasi mudah alih kami dan saluran digital dan telekomunikasi lain, data yang anda berikan kepada kami, bersama dengan maklumat lain yang diminta dan diberikan oleh anda atau kami kepada pihak ketiga tersebut dikendalikan oleh pihak ketiga tersebut sesuai dengan dasar privasinya. Anda harus berwaspada dan membaca kenyataan privasi laman-laman web lain. Kami tidak mempunyai kawalan ke atas data peribadi yang anda serahkan kepada atau terima daripada pihak ketiga ini. Kami tidak menyokong amalan dan kandungan laman web mana-mana pihak ketiga.

10. Penarikan Persetujuan untuk Tujuan Pemasaran

Anda berhak meminta kami untuk tidak menggunakan data peribadi anda bagi tujuan pemasaran. Jika anda tidak lagi ingin menerima mesej pemasaran daripada kami, anda boleh meminta untuk menarik balik keizinan anda dengan menghantar e-mel atau menulis kepada Pegawai Perlindungan Data kami, atau jika berkenaan, menggunakan kemudahan henti melanggan yang terkandung dalam mesej pemasaran.

11. Akses Data dan Pembetulan

11.1 Anda mempunyai hak untuk mengakses dan/atau membetulkan apa-apa data peribadi yang kami miliki mengenai anda, tertakluk kepada keperluan APDP. Sekiranya anda ingin meminta salinan data peribadi anda yang dimiliki kami (hak tersebut tertakluk kepada pengecualian yang dikenakan), atau untuk mengemas kini dan/atau membetulkan data peribadi yang telah anda berikan kepada kami sebelum ini, sila hubungi Pegawai Perlindungan Data kami.

Permintaan Akses Data

11.2 Kami akan memerlukan maklumat yang cukup daripada anda untuk memastikan identiti anda serta sifat permintaan anda, supaya dapat menguruskan permintaan anda. Kami berhak, atau mungkin, mengenakan bayaran yang munasabah untuk memproses sebarang permintaan akses data.
11.3 Untuk permintaan mengakses data peribadi, kami akan berusaha memberikan data peribadi yang relevan dalam masa 21 hari dari tarikh penerimaan untuk permintaan anda. Sekiranya kami tidak dapat memberi maklum balas kepada anda dalam tempoh 21 hari tersebut, kami akan memberitahu anda tentang perkara-perkara berikut secara bertulis:
1. bahawa kami tidak dapat mematuhi sepenuhnya permintaan anda dalam tempoh 21 hari;
2. pernyataan sebab kami tidak dapat melakukannya;
3. sejauh mana kami dapat mematuhi permintaan anda; dan
4. masa yang secepat mungkin untuk kami dapat memberikan anda dengan maklumat yang diminta.

Permintaan Pembetulan Data

11.4 Untuk permintaan membetulkan data peribadi, sebaik sahaja kami mempunyai maklumat yang mencukupi daripada anda untuk menguruskan permintaan itu, kami akan membetulkan data peribadi anda dalam tempoh 21 hari dari tarikh penerimaan untuk permintaan anda dan membekalkan anda dengan salinan data peribadi yang diperbetulkan. Sekiranya kami tidak dapat melakukannya dalam tempoh 21 hari tersebut, kami akan memberitahu anda tentang perkara-perkara berikut secara bertulis:
1. bahawa kami tidak dapat mematuhi sepenuhnya permintaan anda dalam tempoh 21 hari;
2. pernyataan sebab kami tidak dapat melakukannya;
3. sejauh mana kami dapat mematuhi permintaan anda; dan
4. tempoh masa yang secepat mungkin yang praktikal untuk kami boleh membuat pembetulan.
11.5 Sila maklum bahawa APDP mengecualikan beberapa jenis data peribadi daripada tertakluk kepada permintaan pembetulan anda dan juga menyediakan situasi untuk pembetulan tidak perlu dibuat oleh kami walaupun menerima permintaan anda. Jika ini berlaku, kami akan, tidak lewat daripada 21 hari dari tarikh penerimaan permintaan anda, memberitahu anda tentang perkara berikut secara bertulis:
1. bahawa kami enggan mematuhi permintaan pembetulan data anda;
2. sebab untuk penolakan tersebut; dan
3. sekiranya sebab penolakan itu adalah kerana pengguna data lain mengawal pemprosesan data peribadi yang mana permintaan pembetulan data anda berkaitan, maka kami tidak dapat mematuhi permintaan anda, nama dan alamat pengguna data lain yang berkenaan.
11.6 Kami akan menghantar data peribadi yang diperbetulkan kepada setiap organisasi lain yang data peribadi didedahkan oleh kami dalam tempoh setahun sebelum tarikh pembetulan dibuat, melainkan kami percaya bahawa organisasi lain telah berhenti menggunakan data peribadi untuk tujuan bagi data peribadi didedahkan kepada pihak ketiga.

12. Proses Aduan

12.1 Sekiranya anda mempunyai sebarang aduan atau kilanan mengenai cara kami mengendalikan data peribadi anda atau mengenai cara kami mematuhi APDP, kami mengalu-alukan anda untuk menghubungi kami dengan aduan atau rungutan anda dengan menulis kepada Pegawai Perlindungan Data kami.
12.2 Sekiranya anda menghantar e-mel untuk aduan yang diserahkan oleh anda, petunjuk anda pada tajuk subjek bahawa ini merupakan suatu aduan APDP akan membantu kami dalam menguruskan aduan anda dengan cepat dengan menyerahkannya kepada kakitangan yang berkaitan dalam organisasi kami untuk mengendalikannya. Sebagai contoh, anda boleh memasukkan tajuk subjek sebagai "Aduan APDP".
12.3 Kami pasti akan berusaha untuk menguruskan sebarang aduan atau kilanan anda dengan cepat dan adil.

13. Umum

13.1 Keizinan anda yang diberikan menurut Dasar Privasi ini merupakan tambahan kepada dan tidak menggantikan sebarang keizinan lain yang telah anda berikan kepada kami berkaitan dengan pemprosesan data peribadi anda.
13.2 Untuk mengelakkan keraguan, sekiranya undang-undang perlindungan data peribadi Malaysia membenarkan organisasi seperti kami mengumpul, mengguna atau mendedahkan data peribadi anda tanpa persetujuan anda, kebenaran sedemikian yang diberikan oleh undang-undang itu akan terus terpakai.

Kami berhak untuk mengubah dasar ini dengan atau tanpa notis. Sebarang perubahan pada dasar ini akan dikirimkan dan boleh dilihat di invoice.pantas.com/privacy-notice/.

Penggunaan berterusan perkhidmatan kami selepas kami mengemas kini dasar ini di laman web kami akan menjadi perakuan terhadap pengiktirafan dan penerimaan semakan semula dan persetujuan anda untuk mematuhi dan terikat dengan versi dasar yang terkini.
